• Sprite Khol Seedha Bol Offer (“Offer”) is valid from April 24, 2010 to June 4, 2010, both days included or till stocks last whichever is earlier (hereinafter “Offer Period”).
• Stocks without the Offer also available.
• Offer valid all over India except in the state of Tamil Nadu.
• This Offer is open to all Indian residents except employees of Coca-Cola India Private Limited (hereinafter “COMPANY”) including their family members and the employees (and their relatives) of all its affiliate/associate/subsidiary Companies and their authorized bottlers, suppliers, distributors, advertising and promotion agencies.
• The Company shall not charge any entry fee for taking part in this Offer.
• The Offer is valid on 200 ml and 300 ml glass bottles and 350 ml, 500 ml, 600 ml, 1.25 ltr, 1.5 ltr., 2.0 ltr., and 2.25 ltr., PET bottles of Sprite only (hereinafter referred to as “Sprite Bottle(s)”).
• This Offer has 2 sets of Prizes:

  a) Talktime/Talktime Recharge for winners who participate using a prepaid mobile connection; and b. Oxicash for winners who participate using a postpaid mobile connection. However, only in select outlets in the districts of Howrah, Hoogly, East Midnapur, West Midnapur, South 24 parganas, North 24 parganas, Burdawan, Birbhum, Murshidabad and Nadia and the city of Kolkata in the State of West Bengal (hereinafter collectively referred to as “Select Districts of West Bengal”), the Offer has 3 sets of Prizes:a. Talktime/Talktime Recharge for winners who participate using a prepaid mobile connection;

  b. Oxicash for winners who participate using a postpaid mobile connection; and

  c. Cash Prizes.

• Only in the Select Districts of West Bengal, this Offer has two (2) parts;

  a. Cash Bash Offer and b. Sprite Khol Seedha Bol Offer. CONSUMERS IN SELECT DISTRICTS OF WEST BENGAL MAY GET EITHER A CHANCE TO PARTICIPATE IN THE CASH BASH OFFER OR A CHANCE TO PARTICIPATE IN THE SPRITE KHOL SEEDHA BOL OFFER.

• Cash Bash Offer: The Cash Bash Offer is valid only in the Select Districts of West Bengal, ie, the districts of Howrah, Hoogly, East Midnapur, West Midnapur, South 24 parganas, North 24 parganas, Burdawan, Birbhum, Murshidabad and Nadia and the city of Kolkata in the State of West Bengal.

  a. To participate in the Cash Bash Offer, consumers must buy 200ml and/or 300ml Sprite® glass bottle(s) and look under the crown.

  b. Under the Cash Bash Offer, the Consumer stands a chance to win Cash Prizes.

  c. Crowns under the Cash Bash Offer may have one of the following denominations: Re.2/- (Rupees Two Only), Rs.3/- (Rupees Three Only), Rs.5/- (Rupees Five Only) and Rs.10/- (Rupees Ten Only) printed under them. Consumer is entitled to a Cash Prize of the same amount as that printed under the crown.

  d. Consumer must submit the winning crown to the same retailer from whom the consumer had purchased the said Sprite® glass bottle(s), who will reimburse the amount to the Consumer. The Consumer must submit the crown within the Offer Period in order to avail the Cash Prize.

  e. The retailer in turn must submit the winning crown to the Authorized Distributor / Route Agents for claiming amount disbursed by him to the winning Consumer. The retailer will be reimbursed by way of discount either on subsequent purchase, or free product worth the same value. The retailer will not be entitled to any handling or service charge for handling the crowns and/or disbursement of the Cash Prize.

  f. The retailer must submit the winning crowns within one (1) month of the end of the Offer Period – i.e. latest by July 3, 2010. After this period, the crowns will be considered invalid and no reimbursement will be made against such crowns.

• To participate in the Sprite Khol Seedha Bol Offer (“Offer”), the Consumers will need to buy the Sprite Bottle(s) and look under the crown/back of the label of the Sprite Bottle(s) for a nine digit alpha-numeric unique code (“Unique Code”) printed on it;

  a. After discovering the Unique Code under the crowns/closures/labels, to participate in the Offer, the Consumer will need to SMS to 9870 888 888 or log on to www.sprite.in and enter his/her ten (10) digit mobile number and Unique Code, to submit his/her entry to the Offer (hereinafter referred to as “Entry(ies)), at any time during the Offer Period. On the last day of the Offer Period, no Entries, whether received by way of SMS or through the web portal, shall be entertained after 5 P.M. Entries received after 5 P.M on the last day of the Offer Period, shall be considered as invalid and rejected.

  b. Participants can send their SMSs from any part of India even while roaming from anywhere within the country except Tamil Nadu.

  c. The Unique Code can be entered only once through SMS or Online.

  d. The entire process of conducting the Offer including the SMS and distribution of Prizes is being managed by OXIGEN Services (India) Private Limited (“Oxigen”), a mobile multimedia company engaged in inter alia providing single point recharges across the country and mobile value added services. All communication/ complaints/issues regarding the process and conduct of the lucky draw should be taken up directly with Oxigen.

  e. Once the Consumer has sent his/her Entry to the Offer; the Consumer may receive a confirmation of receipt of Entry by way of a return SMS, in case the Entry was received through SMS or may be displayed on the web portal, immediately after the receipt of Entry through the web portal. It is however, clarified that the SMS confirming receipt or confirmation message displayed on the web portal, shall in no way be deemed/treated as proof of receipt of a valid Entry.

  f. All Entries received shall be thoroughly checked and verified by Oxigen. Any incomplete Entry, or any Entry containing incomplete Unique Code or an Unique Code which already exists in the system or a wrong Unique Code shall be deemed as invalid and rejected and thus shall not be considered for the hourly draws under this Offer. In such cases the Consumer may receive a return SMS informing the Consumer about the invalid Entry, if the Entry was received through SMS, or a message informing the consumer about the invalid Entry, in case the Entry was received through the web portal. It is however, clarified that the SMS confirming receipt or confirmation message displayed on the web portal, shall in no way be deemed/treated as proof of receipt of a valid Entry. a. The COMPANY shall not be responsible for loss of SMS during transit or misdirected messages or for failure, error, omission or delay in transmission of SMS for any reason whatsoever. Proof of messaging is not proof of receipt of the SMS. The decision as regards the receipt or non-receipt of the SMS shall solely lie with the COMPANY and shall be treated as conclusive for all purposes. b. The COMPANY shall not in any way be liable for any disruption or disconnection in the telephone line/broadband connections/wi fi/ data cards etc and all such disputes shall lie with the telecom service provider and not with the COMPANY. c. The Consumers shall have to pay all applicable charges to their telecom service provider(s) for sending the SMS. Standard SMS charges, charged by the respective telecom service provider(s) shall be applicable. d. An hourly draw through random selection will be conducted by Oxigen between 11.00 a.m. and 6.00 p.m. every day during the Offer Period to select 481 winners every hour, from amongst the valid Entries received till the hour of the draw. e. For the first hourly lucky draw to be conducted under this Offer, valid Entries received between 10 AM on 24th April,2010 to 10.59 AM on 24th April,2010 shall be considered. For the second hourly lucky draw to be conducted under this Offer, valid Entries received between 11 AM on 24th April, 2010 to 11.59 AM on 24th April, 2010, shall be considered. This process shall be repeated for all subsequent hourly lucky draws. It is clarified that valid Entries received between 6.00 p.m. in the evening and 10.59 a.m. of the next morning will be considered for the first hourly lucky draw of the next day i.e. the draw to be held at 11.00 a.m. on that day. The last hourly lucky draw under this Offer shall be conducted on 4th June, 2010 at 6:00pm. f. It is clarified that Entries considered for any hourly lucky draw, irrespective of whether or not they have been declared as winner(s), shall not be considered for any subsequent hourly lucky draw under this Offer. For example valid Entries received from 6:00pm on April 24, 2010 to 10:59 am on April 25, 2010 shall only be considered for the hourly lucky draw to be conducted at 11:00am on April 25, 2010 and shall not be considered for any subsequent hourly lucky draws. g. Winner(s) of the hourly lucky draws shall be informed by Oxigen through a SMS, irrespective of whether his/her Entry was received through SMS or through the web portal. It is however, clarified that the SMS shall be sent by Oxigen on the mobile number through which the Entry was sent or the mobile number registered on the web portal. h. The winners of the hourly lucky draw may win one Prize from the following, depending upon whether mobile number registered on the web portal/ mobile number through which the Entry received is a prepaid or postpaid number: i. “Free Talk Time” - Winners who send the winning SMS through a ‘prepaid mobile connection’ will win “Free Talk Time” which could be any amount ranging from Rs.20/- (Rupees Twenty Only) to Rs.4,999/- (Rupees Four Thousand Nine Hundred and Ninety Nine Only). The amount of Free Talk Time shall be credited directly to the winner’s prepaid mobile connection through which the SMS was received under this Offer. ii. “Oxicash” – Winners who send the winning SMS through a ‘postpaid mobile connection’ will win “Free Oxicash” which could be any amount ranging from Rs.20/- (Rupees Twenty Only) to Rs.4,999/- (Rupees Four Thousand Nine Hundred and Ninety Nine Only). The amount of Free Oxicash shall be deposited directly to an Oxigen Account created for the Winner. The Oxicash can be redeemed by the Winner against any transaction permitted atwww.oxigen.com, including but not limited to payment of postpaid mobile connection bills. Free Talk Time and Oxicash are collectively referred to as “Prize(s)”.

• General Terms:
• In all cases the COMPANY reserves the right to check and verify all crowns/closures/labels for their authenticity and reject them if not found genuine. The COMPANY will not be responsible for loss of crowns/closures/labels either in transit or otherwise. All crowns/closures/labels once submitted will become the property of the COMPANY. A prize-winning crown/closure/label shall be considered invalid if it is illegible, mutilated, tampered with, not obtained legitimately, has been transferred or exchanged (whether for consideration or not), contains printing, typographical, mechanical or other errors, or is unclear or it does not have the requisite code.
• Both Prizes and Cash Prizes are non-transferable and non–substitutable. Further, the Prizes are non-encashable. The COMPANY is not liable or responsible for the Prizes nor does it extend any warranty or guarantee thereto. The COMPANY reserves the right to substitute the Prizes of equal or greater value.
• The Prize and/or Cash Prize winners shall execute all such documentation to allow the COMPANY and their assigns to use, display, copy, modify, distribute, publish sell, assign, exchange, license, sub-license, in any and all locations, in any medium, form or format, in any number, the image or likeness and the reproductions thereof, and any biographical information furnished by the winner to the COMPANY.
• The COMPANY, reserves the right to, terminate, modify or extend this Offer, at any time at its absolute discretion, without assigning any reason.
• Decision of the COMPANY will be final and binding regarding this Offer and Prizes.
• All promotional materials, including details on how to enter and claim prizes are part of these Terms and Conditions of Entry.
• In case the Entry of any winner is or is deemed cancelled or the claim of the winner has or is deemed to have lapsed; then the organizers shall have the right to do what they deem fit with the Prize, at their sole discretion.
• In case the winner is a minor, his/her parent (s) or legal guardian may redeem the Prize/Cash Prize at his / her own cost and shall execute such documents as deemed necessary by the COMPANY.
• This Offer is being made purely on a “best effort” basis and is subject to force majeure conditions including acts of God, strikes, war, riots, change of law, statutory prohibitions / restrictions. This Offer cannot be clubbed with any other offer/scheme.
• Any participation in this Offer is purely voluntary and shall be deemed as acceptance of all the terms and conditions of this Offer.
• The Prizes will be given subject to applicable taxes, which shall be borne solely by the winners and subject to compliance with the applicable laws and regulations.
• Pictures depicted are only for illustrative purposes and are not indicative of actual size and/or colour.
• All disputes are subject to the exclusive jurisdiction of the courts or forums in New Delhi.
• Extension 1
• The offer period of Sprite Khol Seedha Bol Offer (“Offer”)for Extension has been extended from June 4, 2010 till June 18, 2010 or until stocks last, whichever is earlier (“Extended Offer Period”).
• 2IN THE EXTENDED OFFER PERIOD THE ‘CASH BASH OFFER’ STANDS WITHDRAWN. It is therefore clarified that in select outlets in select districts of Howrah, Hoogly, East Midnapur, West Midnapur, South 24 Parganas, North 24 Parganas, Burdawan, Birbhum, Murshidabad and Nadia and the city of Kolkata in the State of West Bengal (hereinafter collectively referred to as “Select Districts of West Bengal”), only Sprite Khol Seedha Bol Offer shall be valid. Accordingly in the Select Districts of West Bengal, the Offer shall have only two (2) sets of Prizes: a.)Talktime/Talktime Recharge for winners who participate using a prepaid mobile connection; and b.) Oxicash for winners who participate using a postpaid mobile connection;
• It is also clarified that the last hourly draw under this Offer shall be conducted on June 18, 2010 at 6.00pm.
• Save and except the above, all other original terms and conditions governing the Offer shall remain valid and continue to govern the Offer during the Extended Offer Period.
• Extension 2
• The offer period of Sprite Khol Seedha Bol Offer (“Offer”) has been extended for a second time from June 18, 2010 till June 25, 2010 or until stocks last, whichever is earlier (“Second Extended Offer Period”).
• It is also clarified that the last hourly draw under this Offer shall be conducted on June 25, 2010 at 6.00pm.
• Save and except the above, all other original terms and conditions and the terms and conditions during the first extension governing the Offer shall remain valid and continue to govern the Offer during the Second Extended Offer Period.
